On 25 January DROI will hold a workshop on legitimacy and resilience of electoral processes in illiberal political systems and authoritarian regimes, with briefings from two experts. Professor Thomas Demmelhuber (University Erlangen-Nürnberg) will talk about the functions of elections in non-democratic regimes, and Professor Richard Youngs (Carnegie Europe and University of Warwick) will assess policy options for the EU.

In-Depth Analysis - Tribunal for the crime of aggression against Ukraine - a legal assessment - PE 702.574 - Subcommittee on Human Rights

After examining the innovative character of the proposed tribunal, the paper analyses three main interconnected elements linked to the establishment and functioning of the tribunal: the legal basis for its creation; problems of immunity; and questions of enforcement and implementation of its decisions. In the end, taking into account legitimacy considerations which are of crucial importance in this case, the authors evoke two possibilities. A first option would be to ground the tribunal’s creation in Ukrainian domestic law and on its right to self-defence, which would open the door to prosecute foreign nationals for the crime of aggression, complementing it with an agreement with the United Nations (UN) or another (regional) organisation: the tribunal would thus be ‘established by law.’ A second option, more legitimate as it would be based on the UN Charter, would be to interpret broadly existing legal mechanisms, especially the ‘Uniting for Peace’ resolution. Given the UN Security Council’s inability to discharge its duties due to the veto of one of its permanent members (Russia), the UN General Assembly could exceptionally defer the crime of aggression against Ukraine to the International Criminal Court. In both cases, however, it must be kept in mind that significant problems of legality remain.

The Subcommittee on Human Rights, in association with the Committee on Development and the Delegation for relations with the Pan-African Parliament, will hold a public hearing on the African Union and its human rights and democracy mechanisms. This part (Part I) of the hearing, will focus on the views of the civil society organisations.

Over the past years, the African Union (AU) has adopted various treaties and policies to ensure good governance and the protection of fundamental freedoms of African citizens, i.a. the African Charter on the Rights and Welfare of the Child, African Charter on Human and Peoples' Rights, Protocol to the African Charter on Human and Peoples' Rights on the Rights of Women in Africa, African Youth Charter and the African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa.

The main purpose of the first part of this hearing will be to hear from civil society organisations about the AU human rights and democracy related mechanisms, including the African Commission on Human and Peoples' Rights (ACHPR), the African Court on Human and Peoples' Rights (ACHPR), the AU Commission on International Law (AUCIL), the AU Advisory Board on Corruption (AUABC) and the African Committee of Experts on the Rights and Welfare of the Child (ACERWC).
