…SIX YEARS AFTER THE AACL RETAINED A LEADING BRITSH LAWYER TO REPESENT
ALBANIAN AMERICANS TORTURED AND JAILED IN PODGORICA

 

New York, New York – November 25, 2015 – The European Court of Human Rights in Strasbourg, France, delivered their judgment on November 24 in the case of Kola Dedvukaj & Rrok Dedvukaj v. Montenegro.  The Dedvukajs (who are not related) were represented by Steven Powles—a specialist in international criminal law and human rights—who was retained by the Albanian American Civic League in 2009, shortly after Kola and Rrok Dedvukaj were released from three years of incarceration in the federal prison in Podgorica.

 

Powles, who is a barrister at Doughty Street Chambers in London, was part of a legal team that the AACL’s Balkan Affairs Adviser Shirley Cloyes DioGuardi and President former Congressman Joe DioGuardi had previously worked with on the defense of UCK commanders.  Powles was one of the lawyers defending members of the Kosova Liberation Army before the International Criminal Tribunal for the Former Yugoslavia (ICTY), which resulted in the acquittal and release of Fatmir Limaj and Isak Musliu in 2005.

 

From September 2006 to 2009, the Civic League worked with Members of the US Congress, including the late Congressman Tom Lantos, Congressman Dana Rohrabacher, Congresswoman Ileana Ros-Lehtinen, and then Senator Joe Biden, to secure the freedom of fourteen Albanians, including three Albanian Americans, who were arrested, tortured, and imprisoned in Montenegro in September 2006 on suspicion of terrorist activity.  When that effort—including Congressman Lantos’s appeals to Prime Ministers Djukanovic and Sturanovic for clemency—failed, the Civic League decided to take the Republic of Montenegro to court.

 

The application, which was submitted to the European Court of Human Rights (ECHR) by Steven Powles in January 2010, outlined the violation of the following rights:

 

Article 3 (the prohibition of torture), detailing the subjection of the Dedvukajs to torture, inhuman, and degrading treatment by the Montenegrin police when they were arrested on the morning of September 9, 2006, and documenting the lack of any effective official investigation into this matter

 

Article 5 (the lack of liberty and security of the persons), clarifying that the Dedvukajs were not informed promptly of the reasons for their arrest and any charge against them, and that they were held without charge from September 9, 2006, to December 2007

 

Article 6 (right to a fair trial), in which the main evidence against the Dedvukajs, resulting in their convictions, hinged on a diary by Anton Sinishtaj, which was obtained in an unlawful search, and the Dedvukajs were unable to examine the statement that Sinishtaj made to the police

 

Article 14 (prohibition of discrimination) safeguards individuals from discrimination on any ground such as race, language, religion, gender, and political opinion.  The application stated that the denial of a five-judge court, instead of the three-judge court that heard the Dedvukajs’ case in Podgorica, appears to have been impacted by an arbitrary and discriminatory basis due to the Albanian ethnicity of both men.

 

The application submitted by Steven Powles was merged with Sinistaj and Others v. Montenegro.  The Sinistaj’s lawyer had applied to the Supreme Court and the Constitutional Court in Montenegro, unlike the local lawyer, Kol Camaj, representing the Dedvukajs until they were released from prison in 2009.

 

The Court rejected the complaint on Article 3 (prohibition of torture) on technical grounds. The ECHR held that the Dedvukajs and other applicants failed to meet the six-month requirement for reporting the torture to the ECHR, and yet Rrok Dedvukaj, on September 27, 2006, and Kola Dedvukaj, on September 29, 2006, had submitted statements that were stamped by the Ministry of Justice in Podgorica.   They maintained this complaint at every stage, culminating in their application to the ECHR. It also dismissed Kola Dedvukaj’s claim that he did not receive adequate medical treatment in prison and stated that he had never submitted proof of his torture to anyone except his lawyer.

 

The ECHR ruled in favor only of Pjetar Dedvukaj’s complaint concerning ill-treatment admissible under Article 3 and required Montenegro to pay him 3,000 euros for non-pecuniary damages and 3,500 euros for his costs and expenses.

 

In reaction to the ruling, Shirley Cloyes DioGuardi said that it “set a precedent by rejecting Montenegro’s attempt to block Albanians from appealing to the court by relying on the requirement for all domestic legal remedies to be exhausted.”  The ECHR stated that the applicants had submitted their applications to the court long before the constitutional appeal could have become an effective domestic remedy in Montenegro.

 

Nevertheless, Cloyes DioGuardi said, that “since the ‘Second Section’ of the ECHR found no violation of Articles 3 and 6 for Kola Dedvukaj and Rrok Dedvukaj, the Albanian American Civic League is disappointed with the court’s decision and will give consideration to appealing to the Court’s ‘Grand Chamber.’”

 

After waiting nearly five years for a judgment in this case, Cloyes DioGuardi said that “the Civic League is concerned with the ECHR’s apparent failure to even consider, no less address, one of the central arguments of the Dedvukajs’ complaint:  namely that they had not been afforded a fair trial because they were never given an opportunity at trial to challenge the contents of Anton Sinishtaj’s diary and the statements of a co-accused who did not give evidence.”

 

Cloyes DioGuardi concluded by asserting that, “While Montenegro aspires to be a member of the European Union and NATO, it is not yet a free, open, and democratic society that respects the human and civil rights of all of its citizens, especially its ethnic Albanian population which has a history of nonviolence in Montenegro in spite of Slavic repression and oppression.”

Dedvukajt (që nuk kanë lidhje familjare) janë përfaqësuar nga Steven Powles—një specialist i të drejtës ndërkombëtare kriminale dhe të drejtave të njeriut—i cili u angazhua nga Liga Qytetare Shqiptaro-Amerikane në vitin 2009, menjëherë pasi Kola dhe Rrok Dedvukaj u liruan pas tri vitesh burg në burgun federal në Podgoricë.

 

Powles, një avokat pranë firmës Doughty Street Chambers në Londër, ishte pjesë e një ekipi ligjor me të cilin Këshilltarja për Cështje të Ballkanit, Shirley Cloyes DiOGuardi dhe Kryetari i LQSHA-së, ish-Kongresisti Joe DioGuardi, kishin bashkëpunuar edhe më pare për mbrojtjen e UCK-së. Powles ishte njëri nga avokatët që mbrojti Ushtrinë Clirimtare të Kosovës në Tribunalin e Hagës mbi Ish-Jugosllavinë, dhe kontribuoi në lrimin e Fatmir Limajt e Isak Musliut në vitin 2005.

 

Prej Shtatorit 2006 deir më 2009, Liga Qytetare Shqiptaro-Amerikane ka bashkëpunuar me një numër Anëtarësh të Kongresit të SHBA-ve, duke përfshirë edhe tanimë të ndjerin Tom Lantosh, Kongresistin Dana Rohrabacher, Kongresisten Ileana Ros-Lehtinen, si dhe atëherë Senatorin Joe Biden, për të siguruar lirimin e katërmbëdhjetë shqiptarëve, ku përfshiheshin edhe këta dy shqiptaro-amerikanë, të cilët ishin arrestuar, burgosur, e torturuar në Mal të Zi në Shtator 2006 nën dyshimin e kryerjes së aktiviteteve terroriste. Kur i gjithë ky proces, duke përfshirë edhe apelet e bëra tek Kryeministri Gjukanoviq dhe ai Sturanoviq për lirim, nuk dhanë rezultat, atëherë Liga Qytetare vendosi ta padisë Republikën e Malit të Zi në gjyq.

 

Kërkesëpadia e cila iu dorëzua Gjyqit Evropian për të Drejtat e Njeriut (ECHR) nga Steven Powles në Janar 2010, kishte parashtruar shkeljen e këtyre të drejtave ndaj të burgosurëve:

 

Neni 3 (ndalimi i tortures), ku jepen detaje për torturimin e Dedvukajve, trajtimin e tyre jonjerëzor dhe degradues nga policia malaziase kur këta ishin arrestuar në mëngjesin e 9 Shtatorit 2006, dhe ku dokumentohet mungesa e cfarëdo hetimi zyrtar ndaj kësaj cështje;

 

Neni 5 (mungesa e lirisë dhe sigurisë së personave), ku shpjegohet se Dedvukajt nuk ishin te informuar sic duhej në lidhje me arsyet e arrestimit të tyre apo ndonjëres nga akuzat ndaj tyre, dhe se ata u mbajtën në burg pa aktakuzë nga 6 Shtatori 2006 deri në Dhjetor 2007;

 

Neni 6 (e drejta për gjykim fer), ku evidenca kryesore kundër Dedvukajve që u mor për bazë në dënimin e tyre, ishte një ditar i Anton Sinishtajt, i cili ishte sekuestruar në mënyrë joligjore, dhe Dedvukajt nuk ishin të lejuar të shqyrtonin deklaratën e Sinishtajt dhënë për policinë;

 

Neni 14 (ndalimi i diskriminimit) mbronë individët nga diskriminimi në cfarëdo baze si raca, gjuha, feja, gjinia, apo besimi politik. Kërkesëpadia thekson se mosofrimi i një gjyqi me pesë gjyqtarë, por i vetëm një gjyqi me tre gjyqtarë për të dëgjuar dhe vendosur rastin e Dedvukajve në Podgoricë, duket të ketë qenë rezultat i një vendimi arbitrar dhe diskriminues për shkak të etnicitetit të tyre shqiptarë.

 

Kërkesëpadia e paraqitur nga Steven Powles ishte bashkangjitur me atë të Sinishtajt dhe të Tjerëve vs. Mali i  Zi. Avokati i Sinishtajt kishte apeluar lendën edhe në Gjykatën Supreme e atë Kushtetuese të Malit të Zi, gjë që nuk e kishte bërë avokati local, Kol Camaj, i cili përfaqësonte Dedvukajt deri sa ata u liruan nga burgu në vitin 2009.

 

Gjyqi vendosi të hedhë poshtë kërkesëpadinë për shkelje të Nenit 3 (ndalimi i tortures) për arsye teknike. Gjyqi Evropian për të Drejtat e Njeriut, ECHR, theksoi se Dedvukajt dhe të Tjerët kanë dështuar që të raportojnë torturën në ECHR brenda periudhës ligjore prej gjashtë muajsh nga data kur tortura kishte ndodhur, përkundër faktit që Kola Dedvukaj më 27 Shtator 2006 dhe Rrok Dedvukaj me 29 Shtator 2006 kishin dhënë deklarata të vulosura në Ministrinë e Drejtësisë së Malit të Zi, mu për këtë cështje. Ata e kishin ripërsëritur këtë akuzë cdo here deri në kuliminimin e saj në këkresëpadinë e ngritur pranë ECHR. Gjyqi përjashtoi kërkesën e Kola Dedvukajt për mosofrim adekuat të ndihmës mjekësore sa ishte në burg dhe shtoi se ai kurrë nuk kishte paraqitur ndonjë dokument për torture tek askush tjetër pos avokatit të tij.

 

ECHR vendosi në favor të Pjetar Dedvukajt për keqtrajtim, në kuadër të Nenit 3, duke e obliguar Malin e Zi që t’i paguaj atij një shumë prej 3000 Euro për dëme emocionale dhe 3500 Euro tjera për shpenzime ligjore.

 

Në lidhje me këtë verdikt ka reaguar Shirley Cloyes DioGuardi e cila ka thenë: “ky verdikt ka vendosur një precedan duke refuzuar përpjekjen e Malit të Zi për të bllokuar shqiptarët nga apelimi ndaj drejtësisë vendore në instanca të drejtësisë ndërkombëtare, duke u thirrur në kriterin se së pari duhet harxhuar të gjitha instancat ligjore vendore.” Vendimi i ECHR-së tutje shton se aplikantët paraqitën kërkesëpadinë e tyre pranë këtij gjyqi shumë më përpara se të pritnin ndonjë rezultat nga apeli në Gjykatën Kushtetuese të Malit të Zi, dhe se ky veprim ka qenë i drejtë.

 

Sidoqoftë, Cloyes DioGuardi ka thenë se “pasi që ‘Seksioni i Dytë’ i ECHR-së nuk gjeti shkelje të Nenit 3 dhe 6 për Kola Dedvukajn dhe Rrok Dedvukajn, Liga Qytetare Shqiptaro-Amerikane është e zhgënjyer me vendimin e gjykatës dhe se po konsideron apelimin e këtij vendimi në ‘Dhomën e Madhe’ të Gjykatës.”

 

Pasi është pritur mëse pesë vite për këtë verdikt, Cloyes DioGuardi tha se “Liga Qytetare është e preokupuar me dështimin e dukshëm të ECHR-së për të konsideruar të paktën, por pse jo edhe për të adresuar, njërin nga argumentet kyc të kërkesëpadisë së Dedvukajve: faktin që atyre nuk iu ofrua një gjykim fer sepse ata asnjëherë nuk paten mundësinë që gjatë gjykimit të sfidojnë përmbajtjen e ditarit të Sinishtajt dhe deklaratat e një të bashkë-akuzuari i cili nuk kishte dhënë ndonjë dëshmi.”

 

Cloyes DioGuardi përfundoi duke thenë se “gjerësa Mali i Zi aspiron të jetë një shtet anëtar i Bashkimit Evropian dhe NATO-s, ai ende nuk është një vend i lire, i hapur, dhe demokratik i cili respekton të drejtat njerëzore dhe qytetare të të gjithë qytetarëve të vet, e vecanërisht ato të populates enike shqiptare, e cila ka një histori të rezistencës paqësore kundrejt represionit të vazhdueshëm sllav ndaj tyre.”

Republika Srpska beendet Kooperation mit staatlicher Justiz Adelheid Wölfl aus Sarajevo11. Dezember 2015, 16:43 „Einseitige Ermittlungen“ Am Donnerstag hat die Regierung des bosnischen Landesteils Republika Srpska (RS) entschieden, die Zusammenarbeit mit der Polizei und Justiz auf Staatsebene aufzukündigen. Diesem Entschluss ging eine Razzia der Sonderpolizei Sipa in Bosanski Novi voraus. Die Sipa durchsuchte Behörden in der RS, fünf Personen wurden verhaftet. Es ging um Kriegsverbrechen in dem Ort. Die Regierung der RS sprach von einer „schweren Verletzung“, weil etwa eine Polizeistation durchsucht worden war. In einem Brief erklärten die US-Botschaft, die EU-Delegation und das Amt des Hohen Internationalen Vertreters, dass die RS nicht das Recht habe, sich aus der gemeinsamen Justiz auszuklinken, sondern per Verfassung verpflichtet sei, sich den Institutionen des Gesamtstaats zu fügen. Auch von anderen Politiker kam Kritik: Zeljko Komsic, Chef der Demokratischen Front, sprach von einem „Staatsstreich“. „Einseitige Ermittlungen“ RS-Präsident Milorad Dodik kritisiert seit Jahren die gesamtstaatliche Justiz und behauptet, sie ermittle einseitig gegen Serben. Dodik will dass die RS unabhängig wird, was verfassungswidrig wäre. Dodik sagte nun, dass das Vorgehen der Sipa einen bewaffneten Konflikt hervorrufen hätte können und dass dies nur aus Gewissenhaftigkeit nicht geschehen sei. Er forderte die Abgeordneten der RS auf, den Beschluss der Regierung anzunehmen, die Kooperation mit der Justiz und der Polizei auf Staatsebene zu beenden. Market economy and democracy have brought chaos, corruption and improvisation to the young and dynamic republic. Founded in Canada in 1961, Century International Arms started out selling office equipment in Montreal. The company entered the arms trade after it bartered used typewriters for a trunk of Enfield rifles and made a tidy profit selling the guns, according to a trade publication.

Century Arms moved its headquarters to Delray Beach in 1993, but the company’s owners have had ties to South Florida since the 1960s, business records show. It now leases a gray, 78,000-square foot office complex on South Congress Avenue, across the street from a Palm Beach County sheriff’s substation.

Run by the Sucher family, the closely held company is reaping the benefits of a booming trade in military relics and surplus arms – especially after the 2004 sunset of a federal assault weapons ban.

Working with brokers like Zoller, Century Arms scours the world for surplus military weapons, imports and sometimes modifies them, selling them to collectors. In the past six years, it has bought or sold in the Czech Republic, Nicaragua, Costa Rica, Belgium, France, Israel and Australia, according to the cables.

The Post reported that Century is a buyer and re-seller of military-grade surplus guns and is one of the largest arms dealers in the US. Its specialty is buying weapons from overseas and reselling them to dealers.

This is not the first time Century International Arms has made news headlines, either. The Palm Beach Post reported the same dealer had benefitted from an illegal arms trade of pistols, sniper rifles and assault weapons with the help of “unauthorized brokers” – an Israeli arms dealer middleman. The weapons moved into the possession of Century from stock in a Guatemalan government warehouse in 2007, for $130 million.

The revelation came from information provided by WikiLeaks’ trove of secret diplomatic cables – the same cables said by the US government to have been provided by former US Army intelligence analyst Chelsea Manning, who is serving a 35-year sentence in prison for the leak.

An employee of the same arms dealer was involved in supplying arms, including rockets and grenades, to the Contras of Nicaragua during the 1980s Iran-Contra scandal under President Ronald Reagan.

There are other implications, too, including that Century Arms’ Romanian-manufactured WASR-10 rifle is a favorite with Mexican drug cartels. Hundreds have been linked to crimes in Mexico, according to the Center for Public Integrity.

Hackers Reveals Turkey’s Weapons Shipment for Al-Qaeda in Syria Secret official documents about the searching of three trucks belonging to Turkey’s national intelligence service (MIT) have been leaked online, once again corroborating suspicions that Ankara has not been playing a clean game in Syria.

According to the authenticated documents, the trucks were found to be transporting missiles, mortars and anti-aircraft ammunition. The Gendarmerie General Command, which authored the reports, alleged, “The trucks were carrying weapons and supplies to the al-Qaeda terror organization.”

But Turkish readers could not see the documents in the news bulletins and newspapers that shared them, because the government immediately obtained a court injunction banning all reporting about the affair.

When President Recep Tayyip Erdogan was prime minister, he had said, “You cannot stop the MIT truck. You cannot search it. You don’t have the authority. These trucks were taking humanitarian assistance to Turkmens.”

Since then, Erdogan and his hand-picked new Prime Minister Ahmet Davutoglu have repeated at every opportunity that the trucks were carrying assistance to Turkmens.

Public prosecutor Aziz Takci, who had ordered the trucks to be searched, was removed from his post and 13 soldiers involved in the search were taken to court on charges of espionage. Their indictments call for prison terms of up to 20 years.

In scores of documents leaked by a group of hackers, the Gendarmerie Command notes that rocket warheads were found in the trucks’ cargo.

According to the documents that circulated on the Internet before the ban came into effect, this was the summary of the incident:

-On Jan. 19, 2014, after receiving a tip that three trucks were carrying weapons and explosives to al-Qaeda in Syria, the Adana Provincial Gendarmerie Command obtained search warrants.

-The Adana prosecutor called for the search and seizure of all evidence.

-Security forces stropped the trucks at the Ceyhan toll gates, where MIT personnel tried to prevent the search.

-While the trucks were being escorted to Seyhan Gendarmerie Command for an extensive search, MIT personnel accompanying the trucks in an Audi vehicle blocked the road to stop the trucks. When MIT personnel seized the keys from the trucks’ ignitions, an altercation ensued. MIT personnel instructed the truck drivers to pretend their trucks had malfunctioned and committed physical violence against gendarmerie personnel.

-The search was carried out and videotaped despite the efforts of the governor and MIT personnel to prevent it.

-Six metallic containers were found in the three trucks. In the first container, 25-30 missiles or rockets and 10-15 crates loaded with ammunition were found. In the second container, 20-25 missiles or rockets, 20-25 crates of mortar ammunition and Douchka anti-aircraft ammunition in five or six sacks were discovered. The boxes had markings in the Cyrillic alphabet.

-It was noted that the MIT personnel swore at the prosecutor and denigrated the gendarmerie soldiers doing the search, saying, “Look at those idiots. They are looking for ammunition with picks and shovels. Let someone who knows how to do it. Trucks are full of bombs that might explode.”

-The governor of Adana Huseyin Avni Cos arrived at the scene and declared, “The trucks are moving with the prime minister’s orders” and vowed not to let them be interfered with no matter what.

-With a letter of guarantee sent by the regional director of MIT, co-signed by the governor, the trucks were handed back to MIT.

-Driver Murat Kislakci said in his deposition, “This cargo was loaded into our trucks from a foreign airplane at Ankara Esenboga Airport. We are taking them to Reyhanli [on the Syrian border]. Two men [MIT personnel] in the Audi are accompanying us. At Reyhanli, we hand over the trucks to two people in the Audi. They check us into a hotel. The trucks move to cross the border. We carried similar loads several times before. We were working for the state. In Ankara, we were leaving our trucks at an MIT location. They used to tell us to come back at 7 a.m. I know the cargo belongs to MIT. We were at ease; this was an affair of state. This was the first time we collected cargo from the airport and for the first time we were allowed to stand by our trucks during the loading.”

-After accusations of espionage by the government and pro-government media, the chief of general staff ordered the military prosecutor to investigate,. On July 21, the military prosecutor declared the operation was not espionage. The same prosecutor said this incident was a military affair and should be investigated not by the public prosecutor, but the military. The civilian court did not retract its decision.

The government cover-up

Though the scandal is tearing the country apart, the government opted for its favorite tactic of covering it up. A court in Adana banned written, visual and Internet media outlets from any reporting and commenting on the stopping of the trucks and the search. All online content about the incident has been deleted.

The court case against the 13 gendarmerie elements accused of espionage has also been controversial. The public prosecutor, who in his indictment said the accused were involved in a plot to have Turkey tried at International Criminal Court, veered off course. Without citing any evidence, the indictment charged that there was collusion between the Syrian government, al-Qaeda and the I“slamic State“ (IS). The prosecutor deviated from the case at hand and charged that the killing by IS of three people at Nigde last year was actually carried out by the Syrian state.

At the moment, a total blackout prevails over revelations, which are bound to have serious international repercussions.
